Among other rules of the road, Georgia’s rule related to left hand turns is set in stone: thou shall yield to oncoming traffic prior to making a left hand turn.  In fact, the Highway Administration estimates that roughly 22% of wrecks are caused by left hand turns alone.  And, UPS made notice of an estimate that a left hand turn adds on an additional 30-45 seconds to a road trip.  Apparently, through creating its own software and maps, UPS has been able to avoid left hand turns that saves UPS from 6-8 miles per route, 100,000 metric tons of carbon dioxide per year,  emission pollution equivalent to over 21,000 less passenger cars per year and 10 millions of gas each year.

But, wait, there’s more. A study determined that right hand turns only cause about 1.2 % of all crashes.  And, out of all crashes that occur whilst turning or crossing an intersection, 61% relate to left hand turns as opposed to 3 % as to right hand turns.  If you read further, you discover that left hand turns are three times more likely to result in a fatal wreck.  Thus, if you are a pedestrian, it is probably better to use a sidewalk to the right of moving traffic.

I have been practicing personal injury law for over 25 years.  I represent motorists that have been injured by the negligence of drivers that have made left hand turns.  The law in Georgia, O.C.G.A. 40-6-71, basically mandates that drivers intending to turn left must yield the right of way to any vehicle approaching from the opposite direction irrespective if that vehicle is in an intersection or so close to one that it is a hazard.

Auto-Insurance Claims – contemporary perspectives

In today’s dynamically complicated claims regime, more and more individuals are said to be hiring attorneys to represent them in their cases. There are many reasons that have been advanced for the progressive change. The Insurance Research Council conducted a study to find out the exact percentages of persons represented in personal Injury Protection cases to be 36%. This was a five (5) % increase from 2012 and close to 20% in the 1970s. In reality, this can be alluded to the increase in public awareness about legal issues and civilian control over the law. In the examination of the 2012 study, several factors as associated with the involvement of attorneys come to play. Represented claimants had issues as listed below that would lead to other legal issues as reported:

  • First, represented claimants were likely to receive treatment in pain from a hospital or clinic and also undergo MRI scanning and imaging for injuries that were similar to unrepresented claimants.

fitbitWorried that your fitbit may be used against you in a situation where you are injured in an accident? Fitbits are technological devices that are readily available in the market and are crafted to track your physical activities that may range from your heart rate monitoring to your body weight. Personally, I have a Fitbit. One of my friends recommended it to me at a time when I needed to be my own health coach. My core reason for purchasing a Fitbit was to track my exercise activities and sleep pattern.

After buying it, I was all hands on deck determined to make it useful and make a positive change in my life. At first, it was difficult to get used to sleeping with a gadget on my wrist since am not a gadget person. However, my sheer determination to track my physical activities made me adopt to it. Since then, I have grown to enjoy it and I would say that I can’t do anything without it.

One day as I was going through the advantages and disadvantages of using a Fitbit, it came to my attention that the data collected by the gadget can be used in court cases as admissible evidence. This puzzled me and made me develop reservations about using Fitbit.

Is technology a blessing or a curse? There’s a terrifying realization that every moment over 1,000,000 Americans are using their phone or other electronic devices while driving. Texting and driving has become extremely rampant. Look around and you will always see someone doing something with the phone while they are supposed to keep their eyes on the road. I have come to realizee that most Americans use their phones while driving yet they constantly lie about it.

Most of them of course are opined that they are pros that have defied all studies that are against texting and driving. They believe that they are good at what they do and have surpassed everyone. Well here is the plain truth folks! Texting and driving is unsafe for everyone including you!! Unless you don’t value your life, you are treading on a very dangerous road!

The truth of the matter is, in case you are arrested because of texting and driving or injuring someone, you are likely to lie about it. However, technological advancement enables data retrieval that will be used to prove that you were actually texting and driving at the time of may be an accident.

Bellwood: Community comes together to mourn loss of star child student

The northwest Atlanta neighborhood of Bellwood is still in deep mourning following a vehicle incident which resulted in the death of one child and critically injuring another two youngsters.  Atlanta police are still investigating the circumstances, although what is known so far is Isiah Ward, 9, has died from injuries sustained while his brother Roland, and friend Timothy Hood, 12 are still in a critical condition.  Isaiah was kept alive on life support until Sunday afternoon.

The driver of the vehicle, Ryan Lisabeth, 28, is under suspicion of Driving Under the Influence (DUI) while in control of a vehicle which struck the children on the sidewalk of Joseph E. Boone Boulevard on the evening of Friday 22nd May. While Atlanta police continue with their inquiries, the local community has vociferously expressed their support for the families involved and pledged to seek justice on the children’s behalf. Although Lisabeth had sought to be bailed, the judge denied his bond leaving him in custody – which is perhaps a small mercy given the depth of feeling in the community against him and the groundswell of public opinion about the tragedy.

On February 11, 2016 around 1 a.m., a MARTA bus operator collided into a pickup truck driver while operating the bus route covering Cascade Road and Spring Park Drive.  The impact of the crash was a head on collision and the damage to the truck was severe.  The severity of the property damages is not surprising as MARTA New Flyer buses are quite large (35’ – 40’) and may very well weigh between 24,000 – 29,000 lbs.

The driver of the pickup truck was identified as Ashley Mount, 63. The police and MARTA are investigating the collision and it appears that there is video of the incident from an on-board camera in the bus.  The bus operator and four bus passengers were taken to the hospital for treatment. Our heartfelt condolences go out to the family of Ms. Mount.

Metropolitan Atlanta Rapid Transit Authority (MARTA) is a legal entity created by a special act of the Georgia Legislature.  MARTA was created in 1971 and was initially a bus system.  Since that time, MARTA has grown into a bus route network that provides connection to the MARTA rail system of 38 train stations in Fulton, Clayton and DeKalb Counties along with bus service that has been expanded to Cobb and the airport.  Recently, Gwinnett County was pondering a MARTA rail extension.  MARTA services over 438,900 passengers on a daily basis. MARTA is funded by a 1% sales tax in Fulton, Clayton and DeKalb Counties and also receives federal funding.
